Welcome to FurDash. These Terms of Service ("Terms") govern your access to and use of the FurDash website, mobile applications, and services (collectively, the "Service"). Please read these Terms carefully before using the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Our Promise To You

We will never:

  • Terminate your account without notice
  • Lock you out of your own data
  • Change pricing without 30 days notice
  • Sell or share your client data
  • Add hidden fees

1. Description of Service

FurDash provides a software-as-a-service (SaaS) platform designed for mobile pet grooming professionals. The Service includes, but is not limited to:

  • Client and pet information management
  • Vaccination tracking and compliance management
  • Appointment scheduling and calendar management
  • Route optimization for mobile grooming visits
  • Weekly route optimizer for grouping nearby clients
  • Online booking capabilities for your clients
  • Service packages and bundles
  • Automated appointment reminders via email and SMS
  • Rebooking reminders for recurring appointments
  • Client reviews on your booking page
  • Subscription billing for FurDash Pro
  • Email and SMS notifications for appointment updates
  • Two-factor authentication (MFA) for account security

2. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

Your account may be logged in on one device at a time. Logging in on a new device will automatically sign out the previous session. You may revoke all active sessions at any time from your account settings.

You must be at least 18 years old to create an account and use the Service. By creating an account, you represent that you are at least 18 years of age.

3. Subscription and Billing

3.1 Free Trial

We offer a 14-day free trial of the Service. No credit card is required to start your trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.

3.2 Subscription Plans

The Service is offered on a subscription basis with multiple billing period options (monthly, quarterly, semi-annual, and annual). Current pricing is available on our website. Subscriptions are billed in advance for the selected billing period. All fees are quoted in U.S. dollars unless otherwise specified.

3.3 Payment

You authorize us to charge your designated payment method for all fees associated with your subscription. If your payment method fails, we may suspend or terminate your access to the Service.

3.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to all features until that time. We do not provide partial refunds for the current billing period.

3.5 Price Changes

We reserve the right to modify our pricing. We will provide at least 30 days' notice of any price increase. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4. Your Data and Responsibilities

4.1 Your Data

You retain ownership of all data you input into the Service, including client information, pet details, appointment records, and business data ("Your Data"). You grant us a limited license to use Your Data solely to provide and improve the Service.

4.2 Data Accuracy

You are responsible for the accuracy of Your Data. We are not responsible for any consequences arising from inaccurate or incomplete data you provide.

4.3 Client Consent

You represent and warrant that you have obtained all necessary consents from your clients to:

  • Store and process their personal information in the Service
  • Send them appointment reminders and notifications via email and SMS

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service
  • Use the Service to send unsolicited communications (spam)
  • Resell or redistribute the Service without authorization
  • Use automated means to access the Service without permission

6. Third-Party Services

The Service integrates with third-party services, including:

  • Payhip for subscription billing and payment processing
  • Brevo for sending email notifications to your clients
  • Telnyx for sending SMS text message notifications to your clients
  • Mapbox for address geocoding and route optimization
  • Cloudinary for image storage and delivery
  • Turnstile for CAPTCHA and bot protection during registration and login

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

7. Intellectual Property

The Service, including its design, features, and content (excluding Your Data), is owned by FurDash and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written consent.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency repairs or updates
  • Circumstances beyond our reasonable control

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FURDASH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

While we work hard to provide a great service, we can't make any absolute guarantees. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your requirements, be error-free, or operate without interruption. Route optimization suggestions are provided as guidance only; you are responsible for your driving decisions.

11. Indemnification

You agree to indemnify and hold harmless FurDash and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Termination

We may suspend or terminate your access to the Service only for violation of these Terms. We will provide 72 hours written notice before termination for all cases except immediate security risks. Upon termination:

  • Your right to use the Service will immediately cease
  • You may request a copy of Your Data within 90 days of termination
  • We will retain Your Data for at least 90 days following termination to give you adequate time to export your information

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and the language shall be English.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. This limitation applies regardless of the legal theory of the claim.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

16. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and FurDash regarding the Service.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
  • Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign these Terms without our consent. We may assign these Terms without restriction.
